Terms of Use & Service Agreement

Effective Date: June 10, 2026

These Terms of Use and Service Agreement ("Agreement") govern the use of services, website, booking systems, memberships, packages, gift cards, and communications provided by CSMTLGY Inc. operating as Venus Nails & Spa ("Venus Nails & Spa", "we", "our", or "us").

By accessing our website, booking an appointment, purchasing products or services, participating in promotions, or receiving services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

2.ELIGIBILITY

Clients must be at least 18 years of age to independently consent to services.
Clients under the age of 18 must have the consent of a parent or legal guardian before receiving services.
Venus Nails & Spa reserves the right to request proof of age or guardian authorization.

3.APPOINTMENTS AND BOOKINGS

Appointments may be made through:

Fresha
Website forms
Phone
SMS
Email
Social media platforms
In-person bookings

Appointment times are reserved specifically for each client.

Clients are responsible for providing accurate contact information when booking.

We reserve the right to decline or cancel appointments at our discretion.

4.CANCELLATION POLICY

We require a minimum of 24 hours' notice for appointment cancellations or rescheduling.

No Fee

Appointments cancelled or rescheduled at least 24 hours before the scheduled appointment time will not incur a fee.

Late Cancellation Fee

Appointments cancelled with less than 24 hours' notice may incur a fee of up to $25.

No-Show Fee

Clients who fail to attend a scheduled appointment without notice may be charged a fee of up to $25.

Repeated no-shows or late cancellations may require a deposit before future bookings.

5.LATE ARRIVALS

Clients arriving late may receive a shortened service to avoid impacting other appointments.
If a service cannot be reasonably completed due to late arrival, the appointment may be treated as a late cancellation or no-show.

6.PAYMENT TERMS

Payment is due upon completion of services unless otherwise agreed in writing.
We accept various forms of payment including cash, debit cards, credit cards, gift cards, and other approved payment methods.
Prices are subject to change without notice.
Applicable taxes will be added where required by law.

7.REFUND POLICY

All service sales are final. Venus Nails & Spa does not provide cash refunds or credit card refunds for completed services.

Service Corrections

If you are dissatisfied with a service, you must notify us within 5 days of the appointment. At our sole discretion, we may offer:

A corrective service
Partial store credit
Alternative resolution

Corrective services will only be provided when the issue is directly related to the original service.

Results that vary due to personal preferences, lifestyle factors, failure to follow aftercare instructions, or individual biological differences may not qualify for corrections.

8.GIFT CARDS

Gift cards are:

Non-refundable
Not redeemable for cash except where required by law
Not replaceable if lost, stolen, or damaged
Subject to verification before redemption

Gift cards may not be resold without written authorization from Venus Nails & Spa.

9.MEMBERSHIPS, PACKAGES, AND PREPAID SERVICES

Memberships, treatment packages, and prepaid services are:

Non-refundable
Non-transferable unless otherwise approved
Subject to expiration dates where disclosed

Unused services may expire according to the package terms provided at purchase.

Venus Nails & Spa reserves the right to modify membership benefits, pricing, or package offerings.

10.HEALTH DISCLOSURES

Clients are responsible for providing accurate and complete information regarding:

Allergies
Skin conditions
Medical conditions
Medications
Sensitivities
Pregnancy status where applicable

Failure to disclose relevant information may affect treatment outcomes and may limit our ability to safely provide services.

Venus Nails & Spa reserves the right to refuse service where health or safety concerns exist.

11.ACKNOWLEDGEMENT OF RISKS

Clients acknowledge that beauty, spa, skincare, nail, and wellness services involve inherent risks, including:

Skin irritation
Allergic reactions
Sensitivity
Redness
Swelling
Temporary discomfort
Infection risks
Unsatisfactory cosmetic outcomes

Individual results vary.

Venus Nails & Spa does not guarantee specific results.

12.LIMITATION OF LIABILITY

To the fullest extent permitted by law, Venus Nails & Spa, CSMTLGY Inc., its owners, employees, contractors, affiliates, and representatives shall not be liable for:

Indirect damages
Consequential damages
Lost income
Emotional distress
Loss of opportunity
Personal dissatisfaction with cosmetic outcomes

Our maximum liability arising from any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim.

Nothing in this Agreement limits rights that cannot legally be excluded under applicable Canadian law.

13.CLIENT CONDUCT

Clients must treat staff, contractors, and other guests respectfully. We reserve the right to refuse or terminate service for:

Harassment
Abusive behavior
Threatening conduct
Intoxication
Unsafe behavior
Fraudulent activity

No refunds will be provided if services are terminated due to inappropriate conduct.

14.PHOTOGRAPHY AND MEDIA CONSENT

Separate written consent will be obtained before using:

Client photographs
Videos
Testimonials
Treatment results

for marketing, social media, advertising, educational, or promotional purposes.

Clients may decline participation without affecting their ability to receive services.

15.WEBSITE USE

Users agree not to:

Use the website unlawfully
Attempt unauthorized access to systems
Upload malicious code
Interfere with website functionality
Violate intellectual property rights

We reserve the right to suspend access for violations of these Terms.

16.INTELLECTUAL PROPERTY

All content on the Venus Nails & Spa website, including logos, branding, images, videos, text, graphics, and designs, is owned by or licensed to CSMTLGY Inc. and protected by applicable intellectual property laws.

No content may be copied, reproduced, distributed, or modified without prior written permission.

17.SMS COMMUNICATIONS

By providing your mobile number and opting in, you consent to receive appointment reminders, confirmations, service notifications, promotional offers, and marketing messages.

Message frequency varies. Standard message and data rates may apply.

You may opt out at any time by replying STOP. For assistance, reply HELP or contact us directly.

18.EMAIL COMMUNICATIONS

By subscribing to our email communications, you consent to receive promotions, newsletters, exclusive offers, appointment information, and service updates.

You may unsubscribe at any time using the unsubscribe link included in emails.

19.PRIVACY

Your use of our services is also governed by our Privacy Policy.

By using our services, you acknowledge that you have read and understood our Privacy Policy.

20.FORCE MAJEURE

Venus Nails & Spa shall not be liable for delays, cancellations, or inability to perform services due to circumstances beyond our reasonable control, including:

Natural disasters
Severe weather
Government orders
Public health emergencies
Utility failures
Labor disruptions
Technology failures

21.CHANGES TO THESE TERMS

We may modify these Terms at any time.
Updated Terms will become effective upon posting on our website.
Continued use of our services constitutes acceptance of revised Terms.

22.GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
